1. Agreement to Terms
By accessing or using QSO LIFE (the "Service"), you agree to be bound by these Terms of Service and our Community Guidelines (collectively, the "Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and the operators of QSO LIFE ("we," "us," or "our").
2. User Accounts and Registration
To access certain features of the Service, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information. You are solely responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading.
3. User-Generated Content
You are solely responsible for any text, images, schematics, software, data, or other materials you post, upload, or otherwise contribute to the Service ("User Content"). You retain ownership of your User Content. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating and providing the Service. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit.
4. Acceptable Use Policy
Your use of the Service must comply with our Community Guidelines, which are incorporated by reference into these Terms. In addition, you agree not to:
- Violate any applicable national, federal, state, local, or international law or regulation, including any laws regarding the export of data or software, or any amateur radio regulations.
- Engage in any activity that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service.
- Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
- Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
5. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, strictly in accordance with these Terms. All rights not expressly granted to you are reserved by us.
6. Termination
We may terminate or suspend your access to the Service, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
7. Disclaimers and Assumption of Risk
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Content on this Service relates to electronics, engineering, and radio technology, which can be dangerous if handled improperly. You acknowledge and agree that you are solely responsible for taking all necessary safety precautions when working on any projects or following any advice discussed on the Service. We are not liable for any injury, damage, or loss resulting from your reliance on information obtained from the Service.
8. Limitation of Liability
IN NO EVENT SHALL QSO LIFE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
9. Indemnification
You agree to defend, indemnify, and hold harmless QSO LIFE and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) User Content posted on the Service.
10. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in Vernal, Utah, except that you may assert claims in small claims court if your claims qualify.
11. Modifications to these Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
